The Nigerian Bar Association has just replied Umma A. Hikima, Esq, the Hon. Attorney General-General and Commissioner of Justice of Kaduna state and the Kaduna State Government concerning a complaint written against Ms. Gloria Ballason Mabeaim, counsel to Mr. Audu Maikori, former Chief Executive officer of Chocolate City Records.
TheNigerialawyer recalls that Mrs. Gloria had previously written an article titled: “Kaduna State Under Siege” which appeared in the blueprint Newspaper on Monday, April, 10th 2017.
The Office of the Attorney General believing the conduct of Mrs. Gloria to be a breach of professional ethics, wrote a petition against her to the office of the president of the NBA on the 19th day of May, 2017 for an investigation into the matter.
In a reply signed by the General Secretary, Aare Isiaka Abiola Olagunju, Esq and addressed to the Attorney General, the NBA gave reasons why it could not make any investigation into the matter. According to the reply:
“The allegation of defamation and injurious falsehood contained in your petition are tortuous liabilities which are actions in persona and not in term before a court of competent jurisdiction. We are of the considered position that the respondent, who is a newspaper columnist merely, reported, published and expressed her opinion via an article on facts already within the public domain. ”
Citing Section 39 (1) (2) of the Constitution, the NBA concluded that the article complained against does not in any way amount to professional misconduct to warrant any form of possible investigation into the matter and to invoke the disciplinary power of the Association.(The Nigeria Lawyer)
